Case adjourned after defendant sent to the wrong court

The sentencing of a Bideford man has been adjourned after he was sent to the wrong court. Diamantino Pedro was due to appear at Exeter Crown Court but was given a bail notice telling him to report to Barnstaple Magistrates Court. Judge Phillip Wassall adjourned the case for a week so he could be informed of the correct venue and is able to attend. The trainee chef is facing a potential jail term after breaching a suspended sentence for the second time. Pedro, aged 26, of Brecon Close, Bideford, admitted assault by beating and his case was committed to Exeter Crown Court for sentence. His new conviction puts him in breach of a 36-week suspended sentence imposed a year ago for his role in an affray at Crabby Dicks bar in Bideford in February 2012. The father-of-two was one of a group of men who were arrested after a mass brawl outside Crabby Dicks in Cooper Street, Bideford. He was caught on CCTV using his belt as a whip after an argument started inside the pub which was packed with customers watching an England Holland football match on television. The trouble spilled onto the pavement outside where the fight moved up and down the street with several customers becoming involved either as participants or as would be peacemakers. Pedro was jailed for 36 weeks, suspended for two years, ordered to do 100 hours unpaid community work and curfewed for four months by Recorder Mr James Tindal.
